Tim E. Sleeth

Of Counsel

Tim is the head of the firm’s Environmental Department. His practice focuses primarily on federal state and local environmental law. He has extensive experience representing clients before federal and state agencies, and in state and federal court on matters including the cleanup and cost allocation of Superfund sites, enforcement of environmental laws and regulations, and disputes with insurance companies regarding environmental indemnification.

Tim also provides counsel regarding environmental, toxic tort and insurance matters in commercial and real estate transactions and litigation, bankruptcy and reorganization proceedings. This includes analysis of insurance policies to identify and close gaps in coverage as well as to obtain a defense under a reservation of rights and the insurer’s duty to defend.

Before joining the firm, Tim was a trial attorney in the Lands and Natural Resources Division of the United States Department of Justice.

Representative Matters

  • Defense of administrative, civil and criminal enforcement actions brought by federal, state and local environmental agencies as a result of alleged violations of clean water, clean air, solid waste and hazardous waste laws.

  • Solid waste and hazardous waste cleanup cost recovery litigation representing both plaintiffs and defendants (including landowners, generators, trustees and lenders).

  • Resolution of disputes with state and local agencies with respect to underground storage tank violations and state storage tank cleanup reimbursement programs.

  • Representation of insureds in insurance coverage disputes, including property, homeowners, environmental, general liability, professional liability, directors and officers and workers compensation insurance.

  • Resolution of contractual issues relating to environmental and insurance matters in property transactions and corporate mergers and acquisitions.

  • Representation of creditors and debtors relating to toxic torts, insurance and environmental claims and disputes in bankruptcy and reorganization proceedings.
