Charmaine T. M. Chiu

Charmaine is a member of the firm’s Board of Directors and is chair of the firm’s integrated Healthcare Practice Team. She is one of only 129 attorneys certified by The Florida Bar in healthcare law, and has maintained this certification since 2012. Charmaine represents health systems and hospitals, academic medical centers, clinically integrated networks, physician group practices, and other healthcare providers in complex transactions and regulatory matters.

Charmaine assists physicians and group practices in growing their reach to patients through the establishment of facilities and services licensed or regulated by the State of Florida’s Agency for Healthcare Administration, including ambulatory surgery centers, pharmacies, diagnostic imaging centers, and clinical laboratories.

Charmaine forms clinically integrated networks and accountable care organizations, including advising clients on compliance with Medicare shared savings program rules and requirements. Her work includes negotiating healthcare contracts, navigating issues relating to Medicare and Medicaid reimbursement, handling facility and professional licensure investigations before the Agency for Health Care Administration and Department of Health, and managing peer review and credentialing matters.

Charmaine has expertise in healthcare fraud and abuse matters, including complex analyses under the Stark Law, federal anti-kickback law, and their state law counterparts.

The Jacksonville Business Journal has recognized Charmaine as both a Women of Influence and Ultimate Attorney. Charmaine is a former Chair of The Florida Bar Health Law Section, and a former Chair of The Florida Bar’s Health Law Certification Committee. She is a Jacksonville native with a deep commitment to serving her community, especially those organizations focusing on children’s welfare and the arts. Charmaine is married with two sons.

Representative Matters

  • Formation of a 70+ physician multi-specialty group practice with multiple clinic locations and centralized administrative and ancillary services locations through combination of assets from various individual practices into new entity, with specific focus on meeting Stark Law group practice definition and in office ancillary services exception.

  • Advising health system on development of its new multidisciplinary cancer care line of service, including review and negotiation of exclusive provider agreements, site development agreements, and radiation oncology equipment financing agreements, management of related physician recruitment and credentialing matters, and analysis of healthcare regulatory matters in connection with the same.

  • Advising health system in its acquisition of an ambulatory surgery center and related real property parcel, including development and negotiation of assets purchase and real property purchase agreements, working with nationally recognized third party valuation firm in developing fair market valuation of both facility and real property parcel, and managing Medicare provider based state licensure change of ownership, and related healthcare regulatory issues.

  • Formation of two South Florida clinically integrated networks, each with 200+ physician participants, including development of operating agreements for the networks, advising networks with respect to governance and committee structures, drafting of hospital quality and efficiency program agreements, and assisting on successful applications to the Medicare shared savings program.
