Smith Hulsey & Busey Guides Negotiations for Brooks Rehabilitation in $70 Million Hospital Deal

Smith Hulsey & Busey’s corporate, healthcare, real estate and tax practice groups have assisted the Florida-based healthcare company, Brooks Rehabilitation, in navigating a joint venture with Mayo Clinic Arizona that will result in the development of a 60-bed rehabilitation facility on Mayo’s campus in Phoenix. 

The $70 million project expands the footprint of the firm’s client into Phoenix, Arizona, setting the stage for growth and innovation in post-acute rehabilitation. Construction is anticipated to commence in December, and plans include a three-story, 80,000-square-foot hospital with 60 private patient rooms across eight acres next to Mayo Clinic’s Phoenix hospital.

SHB managing partner M. Richard Lewis Jr. led the deal, along with shareholders Charmaine T.M. Chiu, David W. Roberts and R. Christopher Dix, and associate Samantha W. Roy. The team prepared and negotiated the corporate formation and professional service agreements and negotiated the complex real estate transaction with Mayo Clinic, developer Anchor Properties, general contractor Kitchell, architect Hoefer Welker and civil engineer Kimley Horn.

SHB is also representing the joint venture on its application for tax-exempt status under the Internal Revenue Code.
